Once a vehicle is towed — whether from an accident scene, a breakdown, or a parking violation — owners often aren't sure how long it can legally sit in storage, or what it'll cost to get it back. Here's the general picture in South Africa.
There's no single fixed "hold period"
Unlike some countries with a statutory maximum, South African towing/storage holds are generally governed by the contract or notice given at the time of towing, municipal by-laws (for impoundments), and ordinary storage-lien principles under common law. In practice, a reputable towing company will release your vehicle as soon as storage fees and any outstanding towing costs are settled.
Storage fees accrue daily
Most towing/storage yards charge a per-day storage rate starting from the day the vehicle arrives. The longer it sits, the more it costs — so collecting or authorising insurance/repairer pickup promptly matters financially, not just logistically.
What you'll typically need to release a vehicle
Proof of ownership or authorisation (registration papers or a letter if you're not the registered owner), your ID, the accident/case reference number if applicable, and settlement of any outstanding fees. If an insurer is handling the claim directly, ask the towing company whether they can bill the insurer instead of you upfront.
If a vehicle is unclaimed for an extended period
Storage yards can eventually pursue recovery of unpaid fees, which in some cases can escalate toward the vehicle being sold to cover the debt, following proper legal notice. It's always cheaper and simpler to arrange collection or insurance handover as early as possible rather than let storage days accumulate.
Can a towing company just sell my car if I don't collect it?
Only after following proper legal notice and process for unpaid storage debt — not immediately or without warning. Responding promptly and communicating with the storage yard avoids this entirely.
Does insurance usually cover storage fees?
Many comprehensive policies cover reasonable towing and short-term storage as part of a claim — check your policy wording, and ask the towing company to liaise directly with your assessor where possible.
